ASSUMPTION OF RISK & RELEASE OF NEGLIGENCE CLAIMS
In exchange for permission to enter property owned, leased or managed by Missouri Caves and Karst Conservancy, Inc. (hereinafter referred to as “MCKC”),

I HEREBY RELEASE ALL OF THE FOLLOWING PERSONS & ENTITIES FROM ALL LIABILITY FOR THEIR ASSERTED NEGLIGENCE THAT CAUSES INJURY TO ME WHILE I AM VISITING THE PROPERTY, EVEN IF THE INJURIES ULTIMATELY CAUSE OR CONTRIBUTE TO CAUSE MY DEATH:

MCKC, MCKC’S DIRECTORS, OFFICERS & MEMBERS, THE OWNER(S) & LESSOR(S) & MANAGER(S) OF THE PROPERTY, THE OTHER PARTICIPANTS ON MY TRIP(S) TO THE PROPERTY & THE TRIPS’ LEADER(S), AND ALL OTHER PEOPLE & ENTITIES WHO PARTICIPATE IN EFFORTS TO ASSIST ME IF I AM INJURED ON THE PROPERTY.

I ALSO HEREBY ASSUME THE RISK OF BEING INJURED WHILE ON THE PROPERTY. Some of the most common potential risks of entering the property are slipping, tripping, falling, hypothermia, drowning, dehydration, getting lost or stuck, and rocks falling or shifting.

CELL PHONES DO NOT WORK IN CAVES. CONSEQUENTLY, IF I AM INJURED WHILE IN THE CAVE, ANY RESCUE AND EMERGENCY ASSISTANCE WILL ALMOST CERTAINLY BE SUBSTANTIALLY DELAYED.

If I enter the cave on the property, I agree to wear a suitable helmet to protect my head and to follow all other basic caving safety practices.

I agree an electronic copy of this signed document is valid.

A PARENT OR LEGAL GAURDIAN MUST SIGN FOR MINORS!

Acknowledgement of Understanding: I, the Adult Participant have read this Agreement and understand that I am giving up substantial rights, including my right to sue for damages in the event of death, injury, or loss. I acknowledge that I am voluntarily signing this agreement, and intend my signature to be a complete release of all liability, including that due to the INHERENT RISKS of Activities or the ORDINARY NEGLIGENCE of the Protected Parties, to the greatest extent allowed by law.

Acknowledgement of Understanding: I, the Parent/Legal Guardian of the minor listed below, hereby grant my minor child permission to participate in all Activities. I realize that I am agreeing to let my child engage in a potentially dangerous activity. Further, I have read and fully understand this Assumption of Risk, Waiver of Liability, and Indemnification Agreement, and agree to be bound by this agreement on behalf of myself, my spouse, the minor child, and any party filing on behalf of the minor child. I understand that I am releasing both my right and the right of my minor child to sue for damages in the event of injury, death, or financial loss. I intend my signature to be a complete release of all liability, including that due to the Inherent Risks of Activities or the Ordinary Negligence of the Protected Parties, to the greatest extent allowed by law.

Additionally, I, the Parent/Guardian of the minor child, assert that I have explained the inherent risks of Activities to my minor child and that the minor understands this Agreement. The following signature of the minor is to affirm understanding of the inherent risks of Activities and the voluntary assumption of these risks.
